Acceptance of terms and Conditions

By accessing this site you accept the terms and conditions outlined here and, where relevant, on other pages of this same website. The Derwent Experience reserves the right to make amendments to these Terms and Conditions at any time.

Pricing and Booking Conditions

All experience prices are quoted in Australian Dollars (AUD) and are per person unless otherwise stated. All experiences require pre-booking and are subject to availability at the time of booking. Block out dates, minimum and maximum numbers may apply. Booking conditions may apply and should be asked for and understood at the time of booking.

Disclaimer

The information contained on this website was believed to be accurate at the time of publication and we make all attempts to provide reliable information. The Derwent Experience, its directors and employees, however, provide no warranty as to the completeness, accuracy or reliability of other service providers we rely upon to deliver our experiences. Everything is conducted in good faith. We accept no responsibility for any virus, errors or defects that may occur due to the download of files, links or attachments from this site and note that it is the user’s responsibility to purchase and maintain up to date virus software to minimise the likelihood of this occurring.

Health & Safety

By placing a booking with The Derwent Experience, for yourself, your group you represent, or those in your care, you agree to the following

  • I am solely responsible for personal health and safety, as is every other person on my tour. 

  • I acknowledge that I am physically capable of participating in and completing the activities and I understand that some activities may involve a level of physical exertion to participate.

  • I acknowledge that by informing The Derwent Experience of any medical concerns in advance of my booked tour, it may be possible to adapt the activities to ensure continued health and safety.

  • I also acknowledge that if I do not advise or discuss with The Derwent Experience at the time of booking or prior to departure about any medical or physical conditions that I/we have, that I/we may need to forego participation in some of the planned activities unless a suitable alternative activity can be arranged    

Liability waiver 

Except as provided in the provisions of the Australian Trade Practices Act 1974, you release The Derwent Experience of any liability for injury, death, damage, monetary loss or loss of or damage to property. In the event of a claim, all dealings will be handled by our policy holder.

Weather conditions

Under no circumstances can The Derwent Experience be held responsible for poor weather conditions. Tours and planned experiences will proceed with adaptations to suit the conditions. With sufficient notice we can assist you by amending your booking, however our standard amendments and cancellation policy will remain. If due to safety or risk concerns a tour is cancelled, and no other viable option suitable to both parties is possible then a partial refund withholding 20% will occur.

Images for promotional purposes

The Derwent Experience may take photographs of participants during the course of the day. We will do our best to notify and receive your permission. Photographs taken on tour may be used for advertising and promotional purposes in any medium we choose, including social media. By accepting the terms and conditions at the time of booking, you grant us licence to use such images for publicity and promotional purposes. If you do not consent to your image being used in this way, please be sure to let us know.

Age Policy

The Derwent Experience welcomes all well behaved adults and all well behaved children under adult supervision. Many of the places we visit are licenced premises so we use our discretion when it comes to minors in the care of adults. The legal age for consumption of alcohol in Australia is 18 years of ageThat said, many places we visit do not have an alcohol component and children are very welcome. Please ask about our discount for children.

Transport

The Derwent Experience reserves the right to substitute the primary touring vehicle should the need arise. 

Insurance

Travel Insurance is NOT included in your booking. In the event of a medical intervention being required whilst on tour all care and haste will of course be taken. The Driver / Guide has a valid First Aid Certificate (meaning they have taken the training within 3 years)

Payments

  • The Derwent Experience is not registered for GST therefore GST is not charged or included in the total cost

  • Payments are accepted in Australian Dollars (AU$) only

  • Bookings are not confirmed without payment of the required deposit as below

  • Non-payment of any amounts when due, risks cancellation of your booking without any refund of prior payments made. Notification of this action will be sent to the email address provided on the booking form.

Deposit and Final Payment

  • Public Tours that run each Thursday and Friday require payment in full at the time of booking. 

  • For all other experiences - namely private tours, a 25% deposit is required at the time of booking when booked 30+ days prior to the date of tour

  • Full payment of the balance is due 14 days prior to the date of tour.

  • If booked between 30 days and 14 days of the tour date, 50% payment is required at the time of booking.

  • If booked within 7 days of the tour date, payment in full is required at the time of booking.

Bookings

Bookings can be made online through the 3rd party reservation system or they can be made via direct email or telephone contact. 

Amendments

We understand that you may need to make changes, possibly at short notice. We ask you to contact us to discuss your circumstances, allowing us to assist in whatever way we can.

There is no additional charge to amend your booking (e.g. change of date), however we ask you to advise us of any intended change with as much notice as possible. It’s important to be aware that some fees or additional costs may result from amendment to the itinerary planned. You will be informed of any such additional costs when known.

Cancellations and Refunds

  • Before cancelling your booking, we encourage you to contact us to discuss before doing so, because alternative options may be available (such as rescheduling or voucher for future use).

  • If you need to cancel your booking, please contact us in writing, and we will do our best to accommodate your request in line with “be fair, do right” cancellation policy. We look at these instances on a case by case basis.  

  • If a cancellation is made at short notice due to ill health a medical certificate must be provided and an application made in writing for a full refund less 20%.

  • A short notice cancellation with a significant impact and no chance to recover the lost business will in all likelihood result in no refund.

  • A no show on the day will certainly result in no refund,

  • If The Derwent Experience needs to cancel your tour due to unforeseen circumstances, and alternative arrangements cannot be made, all payments made by you to The Derwent Experience will be refunded in full.
